The Costs of Doing Droid: Acer and ViewSonic Pay Microsoft

Android OS will be able to run unhindered on both the Iconia Smart and ViewPads— but it could cost both Acer and ViewSonic for every single device. The looming threat of lawsuits for patent infringement on Microsoft’s intellectual property have driven many smaller manufacturers to simply cut a deal and pay a per device licensing fee. HTC reportedly already pays five bucks a pop, and now additional companies like Acer and ViewSonic have followed suit.


Microsoft maintains that it holds the patents to many of the key elements of the Android OS, including the Linux Kernal. With the exception of Motorola, most smaller companies have simply chosen to pay rather than fight the giant.


Microsoft’s corporate VP and deputy general counsel of IP and licensing, Horacia Gutierrez, said, “We are pleased that Acer is taking advantage of our industry wide licensing program established to help companies address Android’s IP issues. This agreement is an example of how industry leaders can reach commercially reasonable arrangements that address intellectual property.”


Many are concerned that Microsoft’s continued licensing pursuits will hinder fair competition, and if larger manufacturers running Android capitulate and pay, it will become even harder for smaller companies who simply can’t. Another view is that Microsoft could actually be making more money off of per device Android license fees than it’s making from it’s own Windows based devices.


Similar agreements have already been reached with General Dynamics Itronix, Wistron, Velocity Micro and Onkyo.
